International Data Transfer. Brazilian Data Protection Regulator (ANPD).

Earlier this week, the Brazilian Data Protection Regulator (ANPD) began a procedure to regulate mechanisms for the international transfer of personal data, inviting interested parties to answer questions on the subject until June 17, 2022, with the aim of using such answers to draft a proper regulation regarding this matter.

According to the ANPD, the international data transfer mechanisms have become key instruments for the development of the digital economy.

A proper regulation that enables such transfers is important not only to enable the competitive insertion of Brazilian companies in global value chains, but also to ensure the effective protection of data subjects and their personal data.

Therefore, agility in regulating the subject is important, so that the protection of the personal data of Brazilian holders is not an impediment to the country’s insertion in the global economy, as well as innovation and economic development do not harm the protection of such a fundamental right.

Regarding the worldwide digitized economy, companies increasingly depend on data transfers. Data needs to flow freely across borders, under a mechanism that guarantees due protection without unnecessary restrictions.
